These Terms of Service (“Terms”) govern your use of our website, services, and the purchase of our custom photo magnets. By placing an order with us, you agree to be bound by these Terms.

2. Products & Personalization

  • Our products are custom-made photo magnets created based on the images and specifications you provide.
  • You are responsible for ensuring that the photos, text, or other content you upload do not infringe on third-party rights (e.g., copyright, trademarks, personal rights).
  • We reserve the right to reject any content that is illegal, offensive, or violates the rights of others.


3. Orders & Payment

  • Orders are confirmed once payment has been successfully processed.
  • Prices are displayed in CHF and exclude VAT as indicated at checkout.
  • We accept Shopify Shop Payment, MasterCard, Visa, America Express, Twint, PayPal.

 

4. Production & Delivery

  • Production begins once your order is confirmed.
  • Estimated delivery times will be displayed at checkout, but actual delivery may vary depending on logistics providers.
  • We are not responsible for delays outside of our control (e.g., postal service disruptions, customs delays).


5. Return & Refund Policy

  • As all products are customized, there is no right of return or withdrawal under EU law (Directive 2011/83/EU, Article 16(c)) and Swiss law, unless the goods are defective or not as ordered.
  • If your item arrives damaged, faulty, or incorrect, you must notify us within 3 days with photo evidence. We will repair, replace, or refund as required by law.
  • Please carefully review your order before submitting, as we cannot be held responsible for mistakes in the personalization details you provide.


6. Intellectual Property

  • All designs, branding, and website content (except for customer-uploaded photos) are the property of Memora Designs.
  • By uploading photos or content, you grant us a non-exclusive, royalty-free license to use that content solely for the purpose of producing your order.


7. Liability

  • Memora Designs is not liable for indirect or consequential damages, such as lost profits or emotional distress, arising from the use of our products.
  • Our liability for defective goods is limited to repair, replacement, or refund as required under applicable law.


8. Applicable Law & Jurisdiction

  • For EU customers: These Terms are governed by the laws of the EU member state in which you reside. You may also rely on mandatory consumer protection rights in your country.
  • For Swiss customers: These Terms are governed by Swiss law.
  • Disputes shall be subject to the jurisdiction of the competent courts in Aargau / Switzerland, unless mandatory law provides otherwise.

 

9. Changes to the Terms

We reserve the right to update or modify these Terms at any time. Any changes will be effective upon posting on our website.
